Fair use is asserted in Zeta Phi because:
- It is a symbol used to represent Zeta Phi;
- It is used for identification of Zeta Phi;
- Further, critical commentary on the origin of the badge is provided in the article;
- Because of the unique nature of the design, no replacement free image is possible;
- The image is of sufficiently low resolution to prevent exploitation of the image downstream; and
- Use of the image does not limit the copyright holders' use and/or commercially benefit from the original.
