The Santa Monica Observer Newspaper is a free weekly newspaper founded in Santa Monica in 1998 by David Ganezer. It is one of only two newspapers of general circulation in Santa Monica, as defined by California Government Code Section 6008. This means it is one of only two publications legally authorized to publish certain kinds of legal notices.
These include Fictitious Business Name Statements or DBAs for Doing Business As. The phrase "doing business as" (abbreviated DBA or d/b/a) is a legal term, meaning that the name of the business or operation does not include the legal name of its proprietor, the names of all partners, or the official registered name of the limited partnership or corporation that owns it. Also included are Probate notices, Notice to Creditors, Notice of Trustee Sale (i.e., Foreclosure Notices), Statement of Abandonment, Notice of Auction of Abandoned Property, Notice of Bulk Sale, Service of Summons by Publication, and Notice of Petition for Change of Name.
To give constructive notice to others that a business is using a particular name, DBAs must be published in a newspaper of general circulation in California, pursuant to Cal. Business & Professions Code Section 17918. Other legal notices published in the Observer, include probate notices under the California Probate Code, notice of Bulk Sale under the California Commercial Code, and Notice of Trustee Sale or real property foreclosure notices. Currently, the Santa Monica Observer is the most widely read weekly publication in Santa Monica, California. The Santa Monica Observer Newspaper has a circulation of 20,000 and a readership of 38,300.
