As of December 2007, Richard L. Davis is one of two people currently on death row in the United States for a crime other than murder, the other being Patrick O. Kennedy.
Davis and his girlfriend, Melissa Ticer, were accused of repeatedly sexually assaulting a child from October 2004 to January 2005. Davis had a prior history of mental illness, according to his defense attorney who said "You don't have to kill him to stop him. He is a product of a cycle of sickness" [1].
Davis was convicted of aggravated rape by the First Judicial District Court of Caddo Parish in Louisiana on December 10, 2007, while Ticer is scheduled to be tried for aggravated rape in 2008.
Davis' case may bear on the Supreme Court decision related to use of the death penalty for child rape [2] . The Supreme Court is scheduled to hear arguments in that case in April 2008.[3]
