It is believed that this copyrighted image may be used on the English language Wikipedia under fair use provisions of United States copyright law, provided that this image is used for identification and critical commentary, and in lieu of a free alternative image. The image in question is intended to identify the Nesticle emulator and as part of commentary on its importance to the development of video game console emulation (its usage in the console emulator article) and the continued popularity of the NES among gaming enthusiasts and hobbyists even after production of the system itself was discontinued (its usage in the History of the Nintendo Entertainment System article). The uploader asserts that this image represents but a small fraction of the overall work and does not compete with the legitimate copyright holder.
