Thanks for uploading Image:Heroes and Zeros.jpg. I notice the 'image' page specifies that the image is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a freely licensed image could reasonably be found or created that provides substantially the same information. If you believe this image is not replaceable, please:

  1. Go to the image description page and edit it to add {{Replaceable fair use disputed}}, without deleting the original Replaceable fair use template.
  2. On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace the fair use image by finding a freely licensed image of its subject, requesting that the copyright holder release this (or a similar) image under a free license, or by taking a picture of it yourself.

I, too, have searched for a free replacement for a picture of Heroes & Zeros and have found none. There would seem to exist free replacement images of this band, but if any Wikipedian Free-Image Enforcer searched the internet for one, a picture would not exist, because so few people have been to a Heroes & Zeros concert, and thus, few people have uploaded pictures of them taken at a rock concert. Even so, those pictures would be illegally obtained because concerts prohibit the use of photography (despite everyone doing so). In conclusion, a very low quality image should remain on their wikipedia page until a free replacement can be found, and only until then. Removing the image before finding a replacment leaves wikipedia with less information for its users to idenfity the members of this rock band. -- Ice Ardor

I've added all the appropriate templates and talk page comments to Image:Heroes and Zeros.jpg and Image:Sonic Syndicate.jpg as well as the band articles Heroes and Zeros and Sonic Syndicate. However, am I to understand that the images are in violation of the first criterion because there ARE free images available, or is there some other cryptic legal reason? I'm not very familiar with copyright laws and the like, but is it not the case that the only things making an image free would be the photographers express permission, whether it bee through a GFDL-license or any other written statement? If this is correct, I do not believe there are any free images available at the moment. Would the images then not be considered fair use, or am I way off here?
If the permission of the photographer is not always needed, are press photographs, newspapers and the like, considered free? What about promotional photos on a band web page? It isn't a legal reason. It's not a matter of "fair use" law in the U.S., it's a matter of Wikipedia policy. Our policy says that if a new photograph of the subject could be taken and released under a free license, then we can't use a non-free photograph of the subject. (If the band had split up and no longer performed together, then presumably you couldn't create a new photo of the band, but since the band is still together, the images are considered "replaceable".) So any non-free image, whether from a newspaper or a press-kit or whatever, would not be allowed. Yes, you're right that the only way such an image would be "free" is if the photographer expressly released the image under the GFDL or something similar. Press-kit photos are intended for wide distribution, but they're not "free" -- if you tried to publish one of those in a book without the photographer's permission you would likely get sued. There probably aren't any "free" images of the band currently (although you might try Flickr), but if you or someone wanted to photograph them in concert or on tour, you could release that photo under a free license.

[edit] Obtaining a free Heroes & Zeros image from Flickr

I've searched through Flickr to find pictures of Heroes & Zeros. They have plenty of them, and close ups of the band members, but none of them are released under Creative Commons. Flickr Search for H&Z free images. If you have a Flickr account, I'm wondering if you could ask a couple people who have good pictures of H&Z if they'd be willing to release them under the Creative Commons license so that they may be included in Wikipedia. For some reason Flickr won't let me log in because of cookies, so if you could do that, it'd be greatly appreciated. Ice Ardor 01:37, 25 June 2007 (UTC)

I'm hoping all of these images are in fact of Heroes & Zeros and not some other band. The lighting makes it difficult to distinguish who's who. You might want to double check with the photographers if the picture is in fact a picture of the correct band member. --Ice Ardor 20:26, 1 July 2007 (UTC)
