FROM JMERKEY: The Novell Ruling, and any Court pleadings are currently the subject of sealing orders from the Courts. The Novell/TRG settlement and ruling were sealed after the case was settled with the exception of a single copy of the ruling that was published in the copyrighted US Patent Quarterly Journal. If you post them here, Under Section 203 of the Communications Decency Act, Wikipedia will be liable as will any authors or posters of this content. At present, I view this wiki page as a further attempt at harassement by the SCOX message board "lynch mob". I was wrongly associated with SCO and their litigation against Linux by a group of people who opposed my Open Source Operating System projects. The people behind this are folks who want to ruin my reputation on the internet and create misinformation in order to create false impressions my work is somehow "bad" and "Tainted." I have been threatened with death, shooting, guns, firebombs, rape, murder, and other actions by these people who are behind these postings. Despite Wiki's policies, I will tell all of you that I will take whatever steps are necessary to protect my family from these people and their conduct, and it should be clear just how serious I am about this to wiki. I have contacted wiki's offices on Florida and have obtained the address of service of ALL of wiki's directors and letters will be going out to them this week. I would STRONGLY ADVISE deleting any materials about me for the time being, or sticking to materials and content I have approved and verified for you as factual.

There have been no legal threats posted on this site. There has been a notice posted on Merkeylaw. You need to understand, I am a litigant in a pending Federal Court action as an attorney Pro Se. As such, I have obligations when I see sealed Court documents or there are excerpts from these documents posted to your site to notify people and explain. It certainly looks like a lot of these folks have never been inside a civil action, and it can be a rough and nasty road. I am just trying to save everyone the hassle, me included. Please be aware I have tried **VERY** hard to not make such statements, however, if there is sealed Court language or discussions, and for whatever reason, Novell takes offense, Wikipedia could become a target. Jimbo was a really nice person on the phone when I talked to him, and I love and admire what is being done here. Were Novell to bring action against me and wikipedia, your donators and sponsors could get severely harrassed. There's the Wiki world and there's the real world. They will not fund this effort is it's being sued by Novell. Novell has billions of dollars to spent on litigation, wiki does not. If you see anyone posting the sealed materials, you need to REVOKE them from this site. Revoking me isn't going to solve the problem. There's enough versions of this text already posted here to get you in trouble. I am writing articles about my people. For someone to make statements I am not Cherokee when I am a member of the Cherokee Nation then call me "infamous" is insulting.
You need to understand, in my culture, these types of insults or racial slurs are highly offensive. We are indians, and I am an indian, and we don't react the way most people do. We are **VERY** agressive people as a rule, but good hearted and generous beyond belief. There is also a strong social imperative to obey the rules and the law. This user posted comments which are libel -- period. Now think about it. You block the person complaining but allow the libeler to keep libeling. This is opposite to what you should do. You need to consider what you are doing. All I have to do is back away, Novell will come. They won;t come near this stie if they think I protect it. I have agreements which protect me and what I do. You do not. If it appears you are interering with me removing or noticing these people, they can nail you for "acting in bad faith." OK. Now turn on my account so I can get back to writing about my people and constructing a laguage tutorial and complete description of all the dances, ceremonies, and cherokee culture, and NAIL any of these idiots who want to post libel or harassing comments. Any good lawyer will tell you that your mouth is your worst enemy. Shut off the computer, take the wife and kids out for a nice walk in the country.
