Given that the LOC expects this photo not to be under copyright, and that Leadbelly was a public figure, and that furthermore, the disclaimer goes on to discuss "underlying copyright" on music pieces but that this photo is not music, I think the only relevant sentence on the page is that the LOC believes the photo to be in the public domain. This work is in the public domain because it was published in the United States between 1923 and 1963 with a copyright notice, and its copyright was not renewed. It is not in the public domain in the following countries that do not apply the rule of the shorter term for US works: Canada, China (not Hong Kong, Macao or Taiwan Area), Germany, Mexico, Switzerland, and other countries with individual treaties.
